Delinquent or Criminal? - To Waiver or Not

  1. Carolina was correctly waiver onto Adult court. A girl who has been so badly damaged during her adolescent age and until her criminal act was made. She showed that she had a personality disorder and the jury took that into consideration, but thought it would be best to protect the community from her. Which clearly shows in the the sentencing. This girl was abused physically, and sexually through out her early life. Had 6-7 people that she lived with and at one point was kidnapped from an old family. Her mother was more then likely the cause of her situation. It said that she drank during and after the pregnancy and then started doing crack cocaine. Some chemical or developmental issues could have started as early as that. Her family history goes back 3 generations of constant abuse, so her environment condemned her also growing up. She was also smart in someways, because she connected about how all the guys shes been with and what they had in common. She connected admiration, and acceptance. She had knowledge about what was going on in her life and thought it was totally acceptable. She mentioned in extreme details in a journal about the total count of sexual encounters she has came across with what seems dulled emotions. I do agree that it is wasteful to condemn a life that has just started. The jury probably thought that there was to much bad brain development and this girl has been in this environment for to long and hasn't tried to find a way out that she couldn't be fixed and that she would've got in this situation again down the road when she got out.

    1. I agree that she should have been waived on to adult court. Her past may have had something to do with the shooting but she didn’t have any reason to pull the trigger. I also think the jury was in the right because this girl has be with this group for a long time and she hasn’t tried to change her ways I do believe she would end up back in jail for something just as bad. -Football 456

    2. I don't think that she was a threat to society. I believe that she wanted help but didn't know how to find it. She was a prostitute with a pimp that forced her to have sex for money. If she tried to get away he would have killed her. I also believe that she has a corrupt view on sex. She never said that the men raped her even though that is what she described happened to her. She is not some broken toy that needs to be fixed she is a girl that needs help.

    3. Someone in Cyntoia's position doesn't really have a view of whats acceptable or unacceptable. She never had an actual parental figure to take care of her and so she was never taught any moral values in life. She was in this situation for a very long time and was heading down a criminal path, but like I've stated in my post, when she killed Mr. Allen she truly had no reason to do it; which would point to some kind of mental instability. She thought he was going to hurt her and she decided she needed to take extreme action to save herself, even though that wasn't true and she was just imagining the danger. Someone like Cyntoia can still be taken to a juvenile facility, be given treatment and be educated, so that they can be released out into society as a different person with different values; and the means to lead a life different than the one they had before. - Anonemoose456

    4. i strongly agree with that Cyntoia had no parental figure to take her or to tell her what to do and teach her any moral values in life. Like i stated before, having someone to teach you and guide protect you from doing doing wrong things. In Cyntoia case should not have kill Mr. Allen but there are so many reasons that led her to murder Mr. Allen. rehabilitation system could have help her. soccerboy456

    5. I think Cyntoia did not really have a grasp of what is right or wrong, because of her poor home situation (which she was stuck in for a very long time). Her parents were not actually parents to her, and never taught her morals or correct views in life, so Cyntoia would not know. She associated herself with the wrong people because maybe she thought what they were about was right, which became a negative influence for her and ultimately, brought her to the situation she is in now. I think a combination of a poor home environment and peer influence decided her actions, and she should still be held accountable, but not in adult court. -Morton456

  2. I think that Carolina should be considered a criminal and she should be waved to adult court. I believe that if you are a kid you murder some one that you should be automatically moved up to adult court(waved) and you should first be tried as an adult. I do think that she has had a very bad past but I still don’t think that that is any excuse to murder someone or to take someone’s life away. I think she was mentally stable enough to understand what she was doing and I from the video she seemed like a completely normal kid. She also seemed like a very smart girl she could remember all the guys she was with and what they did she it leads me to believe that she is mentally stable and that she understood what she did was wrong and she knew she shouldn't have shot Mr. Allen. She spent a lot of time in his house and was never afraid of anything until he rolled over she had no reason to shoot Mr. Allen

    1. I disagree with you. If she was sent to juvenile prison she could get the help that she needed. There was still hope for her. I believe that she did have a personality disorders and other problems. She always said that the men forced her to have sex with them; she never used the word rape. She was labeled by men that she was a whore and nothing, and she started to believe them. She was abused and raped by men with guns. Her reason to kill the man was that he had guns and she felt threatened when he reached for something, which in her mind could have been a gun.

    2. Its true that she had no right to kill Mr. Allen. But I do believe there is some mental instability present. Like you said he had treated her nicely and she felt comfortable up until they got into bed. At this point she became uneasy and due to past experiences she was under the impression Mr. Allen was going to hurt her. She shot and killed him, but she didn't do it in cold blood. If she were to be taken and rehabilitated by the state, and given mental health treatment, theres a good chance she could be turned into a productive member of society. -Anonemoose456

    3. Even though she had no reason or right to kill Mr. Allen, I think sending her to adult prison would do more harm than good. Like Snapple456 said, I think the juvenile prison system is a place where she could get the help she desperately needs. It is a toss up if she was mentally stable or not, I personally believe she was not the most stable, with what she went through at home with her parents. I think she can be a working part in society if given the right treatment, which she would most likely get if she went to a juvenile system, and not the adult system. -Morton456

  3. I believe that there was still hope for Cyntoia. A judicial waiver is is a hearing before a juvenile judge who decides if the case is moved to adult court or if it stays in juvenile court. I think she could have been rehabilitated and if I don't think she was a threat to society. When she killed that man she felt threatened and vulnerable. I think that men do not always understand the kind of vulnerability that women, especially a woman who has been abused and raped in the past, feel in that kind of situation. I also think that she did not understand her Miranda rights. She talked about hearing the rights on t.v. I think that because kids hear it on t.v. the word start to lose meaning and they don't understand what it means. I think that if a kid does not fully understand the meaning of the Miranda rights their confession can't be used in court. I also don't think that Cyntoia knew she could have asked for a lawyer. I believe that when reading the Miranda rights to a kid the detective should go into further detail. I also think that anyone under the age of 18 should get a lawyer when being interviewed.

  4. The type of waiver in this case was a judicial waiver, in which a judge makes the decision whether the offender should be put through into adult court or tried as a juvenile. In this case it would have been best to try Cyntoia as a Juvenile. Throughout her life she never had a true parental figure to care for her and teach her right from wrong, she fell in with a bad crowd at an early age and was heavily influenced by them; deciding her path in life. With the lack of a parental figure she trusted and possible mental disorders, she was led to a criminal life style. She had no real reason to kill Mr. Allen, he had treated her nicely and she was expecting to receive payment from him based on a mutual agreement between the two. She shot him because she was mentally unstable, she created the illusion that this man posed a threat to her when he did not. This doesn't make what she did right, but it does mean that the killing was not in cold blood. Cyntoia does have a possibility of being rehabilitated. Its unfortunate that someone had to die before she was arrested, but after spending several years in a juvenile institution its quite possible she could be treated and given an opportunity to turn away from a criminal life style.- Anonemoose456

  6. The waiver should not have happened. The girl, while a murderess, was or is not emotionally equipped I thought. The juvenile court is there to make judgments that help individual delinquents. The girl was basically battered all her life and could we expect more from her? There should be something more the juvenile court could do. Maybe more power should be given to them in cases as these. Learning456

  7. i think the problems Cyntoia had have so much to do what she did to that Mr. Allen. It clearly show that Cyntoia had personality disorder, she grew up in very bad environment, she has no parent who could have tell her do this and don't do this like most of us had, and most importantly she was a sex slave and she has been raped. she was in these situation not because she choose to be but because she thought there was no other way out. most of the times our court system do not look at the action or behavior that led to the crime, they just look at the crime and make judgement on it and i think that is not a JUSTICE. Cyntoia committed this crime as a juvenile and she have been trial as a juvenile. soccerboy456

  8. I believe this could go either way, for one this is a very serious crime so I could understand how waiving her to adult court is substantiated. On the other hand, she is young and may not be of the age to recognize what she has done is wrong and she is emotionally unstable because of her early life of being beaten. If I had to choose a side, I would probably chose to keep her in juvenile court because of her troubled home life with being raped and abused when she was young. I think there is still hope for this girl and she can be "saved". So to reiterate, if I was the judge I would choose to keep her in the juvenile justice system. -Morton456

  9. The judge was able to determined whether the juvenile was heard in an adult court or by a juvenile court. In the case of the video, the offender Carolina was waivered to adult court. It's hard to say whether the decision was right because there were so many outside factors that contributed to her adolescent and criminal behavior. Her mother for one was abusive and didn't play the parent role as she needed to. Carolina had a huge history of abuse whether it was physically or sexually. Not to mention the fact that she wasn't the first one to be abused in her family, it went back several generations. But in the end, would her behaviors be able to be corrected? It seems pretty debatable which is probably the reason why she got waivered over to adult court. ChiefO'Keefe456
