Female Delinquency and Gender Injustice

Female Deliquents and Gender Injustice

  1. "Statistics reveal gender disparity in detention for minor offenses and misbehavior. In 2013, 37 percent of detained girls were locked up for status offenses or technical violations, compared with 25 percent of boys, and 21 percent of girls were detained for simple assault and public order offenses (excluding weapons), compared with 12 percent of boys." It seems like our criminal justice system is almost favoring the boys in some way, which is not right whatsoever! Some people say "boys will be boys", but we need to treat each gender equally! We need to convict boys the same way we do with girls, and it seems to be more prevalent of detaining more girls than boys! Why is this? I believe it is because we hold girls to a higher standard, which is plain wrong! We need to hold both genders to the same standard, and enforce the rules the same way!

    1. AGREE! We need to practice equality and what better way to send a message to the whole world of equality between males and females than the justice system. Now I dont believe the system should make and example of a group a girls and over punish them to show equality. But to them as the same level of expectations. No sex is higher than thee other. They hold one gender to a higher role than the other "Be a man!" "Boys will be boys" "Act like a lady" " That isnt lady like" are all examples of what society has put on gender roles.

    2. I agree with everything you said form giving the statistics to the reason of the justice system needs to be fairer to females. I don’t think that we hold girls to a higher standard exactly its more of different types of rules they can do than boys.

    3. I agree with this. Everyone needs to be treated the same. I do however see that women can be more brutal then men. Women look for revenge. In this day in age everyone is equal. there is less about gender roles. Women can be just as tough as a man. Men should also not get off because their just being men. Genders should never just get a "slap on the wrist." It does not teach anyone anything.

  2. We live in a society that place certain gender roles on certain sexes. Such as girls being emotional and boys not showing their emotions. Girls are suppose to not show any aggression and its ok for men to have bar fights. Curfew and run aways should be helped i think there is other ways to protect them other than placing them in jail. 3. First thing that comes to my head when speaking on the topic is gender equality. How come one gender have the stigma as a "norm" for making mistakes and the other gender it is severely frowned upon once acting out of gender roles? One just gets pushed aside at young age in being "Boys are boys" while the other is "Act like a lady!" Males are also more harsh in punishment more than women are. I don’t see why it can't be given or punished the same. Statistics show that girls are becoming much more familiar with the justice system lately. Percentages have gone up more than 10%! A lot of the crime they are commiting is prostitution, underage drinking, etc. Not as gory as males but do have cases of murder and a small amount of forceable rape. Equality should be pushed but who knows when that will be.

    1. Great response. All people should be treated the same. Whether male or female. Just because women aren't supposed to commit crimes doesn't mean they should be punished more harshly for it. Women are certainly not treated as equals in today's society, even though women can vote, can hold seats in politics, and serve in our military. Why should they be punished more? It is important that all are treated with equality.

  4. This article taught me a lot. I feel that they should treat everyone the same as everybody else in this world. this world would be a much better place if we would smile at one another instead fighting all the time, then we wouldn't have to arrest anyone. Male's are getting caught with rape and that sort of thing. But in males defense females are starting to become as hard as males with what they do to be put in jail. Such as murder, stealing, prostitution, even rape. bodybuilder456

  5. I do not really like how the criminal justice system treats males and females differently even though technically we all have the same rights. Its crazy to see how the amount of selected detention offenses in 2013 for women was more than men in status offenses, technical violations, simple assaults, and public order offenses. If women are increasingly getting arrested more and more I think its a very good idea to start studying into it that way maybe they can find a common factor in why this is happening and shut it down. In my opinion I dislike how girls and guys are sought out to be totally different from men because if a guy hits a girl (which is not okay obviously) everybody thinks he is a terrible person and he will get jail or prison time for that. But if a girl hits a guy then usually the stigma for that girl is "good job way to stand up to a guy" like no if it is not okay for a guy to hit a girl why would it be okay for a girl to hit a guy. Technically speaking equal rights should mean equal fights too.

    1. I agree with your opinion. I do not believe that each gender should get punished differently depending on their sex. Depending on the crime committed, the suspect should be punished by the book. If a female commits murder, she should be punished the same way as a male who committed the same thing. -Eclipse456

    2. I agree with you on how people shouldn't be treated differently. They are both criminals that broke the law so they should both have the same rights. I think its a good idea to look into why females are committing more crimes if the female crime rte continues to rise. Males and Females should both receive the same punishment if they commit the same crime. dragons456

    3. I entirely agree, I think we definitely need to change how we treat girls and boys in the criminal justice system because its not fair. Gender is still being a deciding factor here, we need to change that. We need to make it fair across the board for girls and boys. Ludwig123

  6. It should not matter whether the suspect is a male or female, a crime is a crime. Gender really should not apply when talking about the law. If a female murders an individual, she should receive the same punishment as a male that committed the same offense with the same terms. There are some crimes that females typically get punished for that men really don't. Most of those crimes involve prostitution or less pity crimes like stealing lip gloss or an item not having much worth. Men on the other hand, are more likely to commit more aggressive crimes such as murder, rape, or assault. No matter what the crime is, each gender should be punished according to the book. -Eclipse456

All types of crime is wrong rather they do it together, rather it's the same they should have all the same standards. It's a mess how the criminal justice system has ruled out women LifeImagine789

  7. These days women are still thrown around like they are nothing, especially in a prison system. I am not saying this to be sexist by any means because sometimes men are treated the same. It is hard to not discriminate about the differences between men and women because there are so many factors. There were a few sections in this that really caught my eye; Why they fail to help girls, Mental and Physical Health Problems, and the Amount of Women Being Pushed Through Prison Systems. The reason why girls are so hard to deal with in a prison system or a juvenile system is the fact that they need so much more than men do. Women need more medical attention due to their higher percentage of mental illness'. They struggle because they have yet to find a more effective solution in dealing with females. I find it crazy that there are large amounts of women that are being pushed through the system even though they are not a threat to the society. If they are no threat and did nothing wrong, then why are they still locked up? There could be a possibility of needing mental rehabilitation, but why hold them in prison if you could send them to a different institution, which will help decrease the growing inmate population. It just shocks me how different the system is with women. The medical attention that men get? Women do not get as much. It states that eighty percent of medical needs go without help. In my opinion, that is outrageous. Regardless of the differences between genders, what is done is done and they cannot take back the fact that they disobeyed the law. KayaJ456

  8. I think all criminals should be treated the same no matter if they are male or female. They all committed a crime so they should all receive the same rights. They should all be viewed the same but thats not always true. For some crimes males and females are viewed differently even for committing the same crime. People are more likely to view a female as innocent than they are for males. One thing that caught my attention was in 2013 girls committed more status offenses, technical violations, simple assaults and public order offenses that boys did. They should focus on what is causing females to commit these crimes more often than boys and try and put a stop to it. Females are more likely to commit theft crimes like stealing beauty products and males are more likely to commit more violent crimes. Even if the crimes are different they should be treated the same because they are both criminals that broke the law. dragons456

  9. I see that in this article the statistics show girls are punished way more harder than boys. They make it seem like boys hardly do anything not to say girls dies things have no business doing, they still need to punished the same way. They are both criminals who broke the law even with a different crime they need to prosecuted equally what's fair is fair no ifs buts or ands. In jail a lot of women need more attention then male but then you see male getting more, it really doesn't add up.LifeImagine789

  10. In today’s society that all of us live still sadly treats women different from men. Most of the time it is not in a good way either. Seeing that girls are getting treated like this inside juvenile detention and prisons is absolutely horrific. To me this matter needs to be corrected right now. How disgusting is it to think that some middle age man could be taking advantage of a young teenage girl? “Girls in the justice system experience sexual and physical abuse in their homes at extremely high rates, they have reported experiencing sexual abuse at 4.4 times the rate of their male peers.” I simply couldn’t imagine after the experience in a detention center then being placed into a home that does the exact opposite as what it is supposed to do. The federal and state governments need to act on this pathetic situation. Taggswag456

  11. When it comes to punishment from breaking their law, the judicial system should be blind. Race or gender should have no difference in what kind of punishment they get from a crime. The only that should influence the punishment is the crime, attitude of the person who committed it, and reasoning. The fact that females who commit minor crimes are prosecuted more often then men who commit the same crimes is ridiculous. I do not see why it should make a difference or why it is this way. Before reading this I always figured women would get off with crimes easier then a man would, but I was apparently wrong.

  12. We are looking at the gender and how males and females are viewed differently in the justice system. One of the first things you see is a bar graph that shows you how drastic the rise of female delinquency has become through the years. One of thing that is a shame is the justice system seems to not care for the abused or neglected female juveniles. They seem to just get them through the court system. There is graph that showed the types of offenses committed and yes some are serious but others are more common offenses. Those types of offenses I see males not getting convicted as high of a percentage and that’s a shame because that tells you the disparity of how males and females are look at when committing a delinquent act. And when juveniles commit those acts the females are at a greater risk of being detained than a male is for the same act.

  13. When it comes to prosecution and punishment, genders should be treated equally. If an offense is committed by a male and his sentence results in 5 years in prison, a female's sentence should be equal. Judges should be blind and unbiased when giving offenders their punishment. Regardless of race, gender, sex, sexual orientation, if a crime is committed, the punishment should correlate with the seriousness of that crime. When reading further in the article, it was disappointing to find that females experience an incredibly high rate of sexual abuse in prison. Although these women are criminals in prison, they should be offered protection, for they are still human and deserve that much. Allowing female criminals to be subjected to this easily prevented offence is heinous and prison guards, federal, state, and county, should pay more attention to reducing these numbers.

  14. Gender equality is a very big problem in this world right now. Because some of the time not everyone identifies as male or female. Its sad to say someone that is transgender might get a harsher sentence then someone who just identifies as male or female. Its sad to say but everyone has their bias, and what they believe in will determine how big a sentence someone could get. As you see the number of arrests in women has increased over the past few years, and its sad because a lot of those women who are arrested were not brought up into this world, the same way you or I was brought up in this world.Abuse and neglect all these horrible things these women have experienced sadly sometimes is the reason they are in this lifestyle in the first place. Sadly, the justice system does not usually see it that way. If their was more recourses for women in this world, or maybe if you just give that one girl a second chance she might turn her life around and maybe we could work on reducing these numbers . -dicaprio456

  15. The main theme of this article is women being treated unfairly in the correctional systems. I think the last sentence of this article that says “In this developmental era of juvenile justice, it’s time to end decades of unfairness to girls and young women and treat them with the respect and care they deserve.” sums up what I think about how women should be treated. The first thing that stood out to me was the graph that showed Female proportion of juvenile arrests in 2012 and the number one reason why women were arrested was 76% of them were arrested for prostitution. That is a lot of women being put in jail for prostitution. This article also talks about women being pregnant behind bars, it kind of repeats what the movie showed us in class that a majority of the women lose their child after giving birth to them. Another interesting thing this article states is that majority of the women that are locked up have been sexually assaulted in some way prior to committing a crime. -Barcelona789

  16. Every gender should be treated the same. We are at a time where we are getting away from gender roles. women are doing men's jobs everyday. They have proven that they can be tough like a man. With that being said women should be treated like men. They should not get a slap on the wrist if they do something wrong. They should get the same punishment a man does. I honestly think women can be more brutal than men. Women seek revenge. They go out of their way to make someone pay for what they did. Women also murder, rape, and abuse others. It is not just men. Men are expected to stay silent when a women does that to them. It is wrong. Gender roles are not okay and everyone needs to be treated the same.

    1. Exactly. A women's crime is equal to a man's crime. The same crime is no worse based off of which gender committed it. Society believes that women are more innocent than men, and that they are emotionally unstable and don't deserve to take the full consequences of their actions. But, women are not staying at home in the kitchens anymore, we're in the 21st century and women are no less than men.

  17. This article is well written and shows some of the problems women must deal with in the juvenile delinquency system. Girls are often more anxious and susceptible to stigmatization, and labeling versus their male counterparts. This could cause issues for the women in their futures. They could develop mental defects such as depression or anxiety. Further more girls are arrested and charged for mostly non-violent crimes. These girls should not be punished so harshly. The courts or authorities should exert more discretion. Instead of sentencing these ladies to prison, they should be sent to counseling for fraud or sexual rehab for prostitution. There are so many more solutions for these girls than prison or juvie. Finally the fact that most probation officers don't know how to deal with girls and their needs is quite disturbing. The officers should learn how to take care of them, after all, are women not people?

The percentages of the girls doing what they are doing is way to high and we NEED to find a way to lower it. There is another thing that needs fixed as well, the gender bias, girls get harsher longer treatment than the guys. Ludwig123

  18. There is a big problem with gender equality in the world. Some countries are even worse about it than the one we live in. There is no reason that a boy or girl should get a harsher sentence because they are going against there social norms. Also, women are more likely to be victimized whether it be by a spouse or even a stranger. This makes it so there are more cases of women acting out with violence and such. We should be more sensitive and open to problems that a woman might go through. We can't change that people will be victimized but we can change how we rehabilitate them. Cowboy123

  19. This article is about how girls or females in general are treated in the Juvenile Delinquency System. What really surprised me was how high the level of prostitution was for the graph of female proportions in 2012. It was at 76 percent while something like murder was at nine percent. A lot of the females have trauma, abuse, mental illnesses, and have been victimized when they were little which could cause them to do a delinquent act. Most of the offenses that are committed between girls and boys are status offenses and technical violations. The other thing that was interesting was the “Girl Courts” because it is actually something that is fairly new. It is like probation that girls get to have a support system and focus on new experiences and skills. CSI 123 & 789

  20. The CJ system is rather gender bias. It's very evident that it favors boys actions. By that, I simply mean to say it has a higher leniency rate with boys. Boys get off because its assume that Boys are going to be Boys. They are genetically wired to be rough and boarderline violent. But girls on the other hand, are taught to Act like a Lady. But many forget the other half of that saying, "And Think like a Man". Why is it that women are taught by society to be just as smart as men and to be able to understand the male mind, but they must still conduct themselves as ladies and stay in their places. Why is it that there is a saying that says "Work Hard, Play Hard", yet women are expected to do the soft jobs and refrain from rough housing? It's said that a "Woman's work is never done" , so they DO work hard and therefore should get the equal right to play hard right? So why is it that if a woman engages in a harsh crime, its seen as unlady like and she is penalized more severly that a man who commited the same crime. I said all that to say that punishments and consequences shouldnt be gender biased. There should be an even and fair distrubution of punishment. No one gender should be penalized more than the other for the same crime.

  21. The bar graph shows how drastic the rise of female delinquency has become over the years. It is sad to see that the justice system doesn't have much sympathy for abused girls. They need counselors in jails and prisons so they can figure out and talk it out with someone. IF they can talk it out with someone they can develop a plan and get back on their feet. Most of the offenses are petty offenses and very rarely major crimes. Males committing these type of offenses are not getting convicted at such a high of a percentage because of how males and females are looked at when committing a delinquent act. Society doesn't want juvenile girls committing offenses that young men commit for an example graffiti or fighting.

  22. This article makes you think, because women and men are not equal in judgment for their sentences. If a law is broken and a person is to be punished they should serve the set time that has been issued to them. Though when the next person does the same crime they too should be punished regardless of gender.
I do see where the men are susceptible to higher crimes against society opposed to women. Crimes are all similar and that they all break the law and have reprimances based off of what they are. I was not all that aware of female sentences until now.
I found that the chart was mind blowing as well with the pregnancies and sexual assists before they were behind bars. I think the system needs to focus on rehabilitation and plant the seed in these young women so they can be empowered and feel as if they have self worth.

  23. There's a segment on page 20 that says "For too many girls adversity in their homes, in their communities, and in the way they experience society is traumatizing." This is an illegitimate claim. Does a girl interpret a situation differently than a boy? Sure, girls tend to be more emotional than boy, but it shouldn't be an excuse for the way they act. Girls are not less intelligent than boys, and they can choose to make good decisions over bad. That's like saying males with higher levels of testosterone should be able to use that as an excuse. Yes, some do use this excuse, but I don't believe it makes any difference. Girls and boys should be in separate prisons and jail cells, but I think that should be the extent of the leniency on either part. Girls are no more innocent than men. A crime is a crime and should only be seen as that, not a crime where we wonder which gender committed it.

  24. Yes girls need a different approach when it comes to rehabilitation they should not be treated as guys at all because there needs are completely different from a males. But when it comes to sentencing and the punishment it should not change yes there are certain situations but in general no if a female kills someone in the same context as a male killing someone they should be looked at the same and be punished the same. Rehabilitating a female you would have to come at differently though because females commit crimes for different reasons. For example its more likely that a female will get picked up for prostitution compared to a male witch would maybe get in trouble for picking up a prostitute.

  25. Punishments for crime should be equal for everyone whether the offender is male, female, black, white, or Hispanic. If a man commits a crime and gets 5 years in prison, and a female commits the same crime and only gets 2, clearly something is wrong. A crime should have a set guideline for what the punishment is. It is not right for someone to get special treatment just because they are a female. I do feel like the punishment for prostitution should be less about prison and more about counseling and like a rehab program. I feel as if that would have more positive reinforcements on extinguishing prostitution in the long run. Broncos456

  26. I noticed that the females committed more status offenses then the males did. I believe it is because females mature faster then men do. So, they hang with the older guys whom then can supply what they are not old enough to get. But, that is obviously just in some cases. Then you have to add in the home life. In my experience, I have noticed that being a teenager, if things do not go your way, you act out on it. Upset at home? Run away, make your parents feel disappointed. Women have a lot of emotions compared to men, so they act out on them.

  27. I think that the graph showing the percent of women that get arrested for certain crimes was interesting. I thought it was interesting that 76% of the arrests for prostitution for girls is prostitution and only 2% of rape charge were women. It is the complete opposite for boys. Another part that I thought was interesting was that juvenile girls placed in an adult prison are less likely to learn from their mistakes and have a higher suicide rate. This is because they are not being taught how to turn their life around in an adult prison but instead they are just their being punished. The school to prison pipeline part was interesting as well. This said that schools with a zero tolerance policy and harsh disciplinary measures cause more girls to drop out of school and when they drop out of school they are more likely to commit crimes.

  28. I think seeing the graphs and numbers of females incarcerated over men have for more increased over a span of few years than before. Do I believe that it’s a sexist thing? No. I believe that we are living in a time that women are now starting to express themselves more and starting to take on men roles. I also believe that the past has part to play in their behavior issues, but that can’t be the excuse for every woman that gets sent to jail. The graphs showed from when the women were incarcerated from 1992-2013, and the numbers skyrocketed from the past because they weren’t exposed to what’s happening now to women in today’s society. However, there was another graph that showed the percent of women arrested in each crime category. It was no surprise to me that prostitution the lead the pack with 76%. Like I said before the past can play a role, but it can’t be the excuse every single time. ThinBlue94789
